Abstract
The purpose of this scientific article is to consider the existing divergences regarding the use of firearms in the performance of police activity, especially with regard to the use of the instrument as a skillful means of incapacitating the aggressor, in the face of an extreme situation involving exclusion of illegality. In this context, through an empirical analysis, the questions posed in this work aim to demonstrate the importance of the theme, often so avoided and mystified by public opinion due to its complexity and controversy, bringing solid arguments to support the importance and legality of using a firearm to neutralize an unjust threat. In order to expose an answer to the problem of incapacitation in the current legal scenario, it will be discussed, among other things, the application of the institute of self-defense with emphasis on practical and legal aspects related to the subject.
