A Evolução do Direito de Acesso à Informação até a Culminância na Lei n. 12.527/2011

Abstract
O presente artigo estuda o direito de acesso à informação no contexto dos direitos humanos e a sua evolução conceitual na literatura internacional, com reflexos diretos no conteúdo dos tratados internacionais, nos julgados das cortes internacionais e nos estudos da Organização das Nações Unidas. As limitações ao direito de acesso à informação e a importância da historicidade como característica dos direitos fundamentais fazem surgir os contornos necessários ao reconhecimento do sentido material desse direito. Ao debruçar-se sobre o direito de acesso à informação no Brasil, este artigo aponta a originalidade da Constituição Federal de 1988 ao estabelecer o “writ” constitucional do “habeas data”, bem como a sua diferenciação com o direito estatuído pela Lei n. 12.527/2011, passando o estudo, ainda, pelos diversos projetos legislativos que culminaram na edição da Lei n. 12.527/2011.
