The constitutional-democratic instrumentality of criminal investigation.

Abstract
The article analyzes the role played by criminal investigation in the Social and Democratic State of Law. The old paradigm of individualistic and unidirectional instrumentalization of criminal investigation is no longer in keeping with the spirit of democratic constitutional societies. Thus, we propose the adoption of a new paradigm that reflects the axiological vectors of constitutionalism and democratic societies. The constitutional-democratic instrumentality of criminal investigation is manifested in the protection of constitutional values and in the democratization of its functions. The article is developed in four parts. The first demonstrates the existence of a state legal duty to investigate conduct that violates criminal law as a logical consequence of the right to public security and as an imposition of international human rights law. Next, some aspects of criminal investigation are discussed as a materialization of this constitutional duty. It advances to the discussions around the doctrinal classification of the Brazilian criminal procedure system. Given its inquisitive-guarantee nature, it informs its two cornerstones: separation of functions and external control. The final part brings a reflection on the constitutional-democratic instrumentality of the criminal investigation conducted by the Judiciary Police to the detriment of investigations conducted by the prosecution and the defense.
