Inquérito Policial: necessário e devido processo penal constitucional

Abstract
A pesquisa almeja rediscutir a correção da corrente doutrinária pátria que encara o Inquérito Policial como mero procedimento informativo extraprocessual. Para isso são expostos breves contornos das teorias do processo como relação jurídica de Oskar Von Bülow, do procedimento em contraditório de Elio Fazzalari, até alcançar o preferível modelo constitucional de processo de Italo Augusto Andolina e Giuseppe Vignera, caraterizado pela conjunção dos elementos definidos como expansividade, variabilidade e perfectibilidade. Pari passu, são examinados os principais argumentos injustificáveis utilizados para depreciar o Inquérito Policial, sua relevância e a proeminência da atividade investigatória na afetação dos direitos fundamentais e na realização do direito penal. Com o recorte proposto, - submissão do Inquérito Policial ao crivo do referido modelo constitucional de processo -, e cotejamento do tema em direito comparado e na legislação e jurisprudência nacional, verifica-se que o Inquérito Policial, no estado de direito brasileiro, deve ostentar a natureza de processo penal constitucional.
