Dialogue entre chimie et droit : une approche nécessaire du droit des drogues

Résumé
L'usage de substances psychoactives suit l'histoire de l'humanité. Au Brésil, ils sont contrôlés et punis pénalement par la loi 11.343/2006 (loi sur les drogues). Dans son libellé, l'indication des crimes, des infractions et la nécessité de documents attestant de la matérialité des actes. C'est à ce stade que le droit rencontre les sciences naturelles et que l'écart de compréhension peut se produire. Dans ce travail, la proposition était d'étudier l'intersection de ces domaines du point de vue de la loi sur les drogues. Il a été observé que la littérature nationale manque de ces discussions transdisciplinaires. Il y avait une perception de lacunes à mieux explorer au niveau technique et juridique. C'est pourquoi les principaux articles et la jurisprudence ont été évalués à la lumière des sciences naturelles afin d'établir un dialogue. En outre, le phénomène des nouvelles substances psychoactives et les défis de ces substances dans le cadre de la loi sur les drogues ont été discutés. Au vu de cet ensemble de résultats, il a été entendu que l'articulation des différents visages du droit devait être débattue aussi bien par les professionnels du droit que par les techniciens. Afin de consolider la sécurité juridique sur les substances. Cette conciliation doit être menée de manière à ce qu'aucun droit de l'homme ne soit enfreint.
