Dialogue between chemistry and law: a necessary approach to drug law

Abstract
The use of psychoactive substances is part of the history of humanity. They are controlled and criminally punishable in Brazil by Law 11.343/2006, also known as the Drug Law. This Law indicates the crimes and the documents necessary to certify the materiality of the actions. At this point, the Law meets the natural sciences, but it is also the point at which deviations in understanding can occur. The main goal of this work was to evaluate how scientific and Law fields intersect from the perspective of Drug Law. Articles and jurisprudence were assessed in the light of natural sciences to try to establish an initial dialogue. We observed that the national literature lacks interdisciplinary discussions, which can encourage the lack of dialogue between technical and legal professionals. These documents were also evaluated to introduce the debate on the phenomenon of New Psychoactive Substances and the challenges facing the Drug Law. With the data assessed, we concluded that there is still a need and space for discussions by legal practitioners and science professionals for the best application of the Law. Improving this communication can provide more legal certainty in law enforcement and human rights preservation.
